Terms and Conditions

These terms and conditions determine the conditions, rules and method of sale by Ecotechnics De Leeuwerik
VAT number: NL004679875B53,
KVK number: 88996875, established in Nijkerk and registered in the trade register of the Chamber of Commerce.

The purchase agreement between the seller and buyer is concluded in accordance with Dutch law, in particular Books 6 and 7 of the Civil Code (BW), via the web store www.tegeltechniekshop.nl (hereinafter: the "web store").

§ 1 Definitions

  1. Working days - Days from Monday to Friday, with the exception of generally recognized public holidays in the Netherlands.
  2. Delivery - the actual act involving the seller, through the carrier, the goods listed in the order supplies to the customer.
  3. Carrier - the party with which the seller cooperates for the delivery of goods: PostNL (further parties according to the schedule above)
  4. Password - A series of characters chosen by the customer during registration.
  5. Customer - a natural or legal person.
  6. Consumer - a natural person as referred to in Article 6: 230g, paragraph 1 of the Dutch Civil Code.
  7. Client account - an individual account for the customer.
  8. Login - the customer's e-mail address.
  9. Entrepreneur - a person acting in the context of a profession or company.
  10. Terms and Conditions - This document.
  11. Registration - Creating an account.
  12. Vendor - Ecotechniek de Leeuwerik, VAT number NL004679875B53, KVK number 88996875, located in Nijkerk
  13. Website - www.tegeltechniekshop.nl
  14. Goods - Products offered via the web store.
  15. Sustainable data carrier - as referred to in Article 6: 230g BW.
  16. Purchase agreement - Remote agreement as referred to in Article 6: 230g Bw.

§ 2 General provisions and use

  1. All rights to the web store are the property of the seller and protected by the Copyright Act.
  2. The web store is compatible with common browsers and systems.
  3. Cookies are used in accordance with Article 11.7a Telecommunications Act and AVG.
  4. An active e-mail address is required for use.
  5. It is forbidden to place unlawful content.
  6. Use of internet entails risks - Customer must use appropriate security.

§ 3 Registration

  1. Registration is free.
  2. Registration is not mandatory for placing an order.
  3. Customer fills in a form and chooses a password.
  4. Client accepts the General Terms and Conditions.
  5. Customer can give permission for marketing (AVG).
  6. Permission can be withdrawn.
  7. After registration, customer receives confirmation by e-mail.

§ 4 Orders

  1. Information on the Website does not constitute a range (Article 6: 217 of the Dutch Civil Code), but an invitation to do an offer.
  2. Orders can be placed 24/7.
  3. Customer places order via "I buy and pay".
  4. Order = customer offer.
  5. Seller confirms receipt by e-mail.
  6. Acceptance by seller = Agreement.
  7. Confirmation is provided on a sustainable data carrier.

§ 5 Payments

  1. Prices include VAT and excluding shipping costs.
  2. Prices meet the Omnibus Directive (EU 2019/2161).
  3. In case of actions, the lowest price of the past 30 days is displayed.
  4. Payment methods:
    • ideal
    • PayPal
    • Klarna
    • Bancontact
  5. Customer pays within the specified period.
  6. In the event of non-payment, agreement can be dissolved (Article 6: 265 of the Dutch Civil Code).

§ 6 Delivery

  1. Delivery takes place in accordance with Article 7:17 of the Dutch Civil Code (Conformity).
  2. Delivery time is stated on the website.
  3. Delivery via carrier.
  4. Customer receives shipping confirmation.
  5. Customer checks package upon receipt.
  6. Invoice or voucher is included.

§ 7 Legal warranty (conformity)

  1. Seller is liable for non-conformity (Section 7:17 of the Dutch Civil Code).
  2. Customer is entitled to:
    • Recovery or replacement (Section 7:21 BW)
    • Price reduction or dissolution (Section 7:22 of the Dutch Civil Code)
  3. Costs for seller.
  4. Legal warranty applies at least 2 years.

§ 8 Complaints

  1. Complaints can be submitted in writing or by e-mail: info@tegeltechniekshop.nl
  2. The seller responds within 14 days (Article 6: 2 of the Dutch Civil Code).

§ 9 Right of withdrawal

  1. Consumer can revoke within 30 days (Article 6: 230o BW).
  2. Period starts upon receipt of the product.
  3. Agreement is dissolved.
  4. Seller pays within 14 days (Article 6: 230R BW).
  5. Customer carries return costs (unless stated otherwise).

§ 10 Free Services

  1. Seller offers:
    • Client account
    • Reviews
    • Newsletter
  2. Newsletter is sent by e-mail.
  3. Log out is always possible.

§ 11 Content and liability

  1. Customer is responsible for content.
  2. Content may not violate third parties.
  3. Seller can remove content.
  4. Liability according to Article 6: 196c Bw.

§ 12 Reporting infringements

  1. Infringements can be reported at the seller.
  2. Seller takes action (notice & takedown).

§ 13 Personal data

  1. Processing responsible: Seller.
  2. Data is processed according to AVG and AVG Implementation Act.
  3. Supervisor: Authority of personal data.
  4. Customer is entitled to inspection, correction and removal.
  5. Data secured.
  6. Data can be shared with carriers for delivery.

§ 14 Termination agreement

  1. Both parties can terminate agreement.
  2. Customer can do this by e-mail.
  3. Seller informs by e-mail.

§ 15 Final provisions

  1. Liability according to Dutch law.
  2. Conditions can be saved or downloaded.
  3. Disputes fall under Dutch law (BW).
  4. Consumer can use:
    • EU ODR platform
    • Consumer & Market Authority (ACM)
  5. Seller can change conditions with 7 days notification.
  6. Terms and conditions enter into effect (date).
